The sale price is payable by the Client before the delivery date indicated in this Contract. Germain Larivière shall be entitled to stop any delivery should the Client fail to pay the selling price as planned. Until full payment of the sale price, Germain Larivière shall remain the owner of the merchandise.
Except for the date of payment of the sale price, the delivery date set out in this Contract is indicative only and cannot be considered as a deadline
Should the Client not pay the sale price or not take delivery of the merchandise sold, Germain Larivière shall have the right to cancel the present. No return of merchandise or exchange without prior agreement with Germain Larivière
Deposits are non-refundable.
Germain Larivière stores the purchased products free of charge for a maximum period of 60 days following the delivery date indicated in the Contract. If a longer period shall be needed, the Client shall be required to pay a monthly storage charge of 2% of the selling price of the merchandise. All warehousing of the merchandise shall be of a maximum duration of 6 months.
In the event of a defect, Germain Larivière reserves the right to repair the merchandise instead of replacing it.
A reasonable adult person must be present at the delivery of the merchandise. Any defect in such merchandise must be reported to Germain Larivière upon delivery and be indicated immediately on the delivery voucher before the departure of the delivery person. Otherwise, the goods shall be deemed to have been received in good condition. A $100-fee shall be payable to Germain Larivière if no reasonable adult person is present on the agreed delivery date, to cover a portion of the costs related to the postponement of the delivery of the merchandise.
The Client must ensure that the merchandise shall have adequate dimensions to pass through the doorways and stairs, as well as to be installed in the room determined by the Client.
An interest charge of 24% per annum, or 2% per month, as an administration fee, shall be added to the balance of the sale price from the moment that the Client shall fail to pay the balance as expected in the present Contract.
The Client acknowledges to have read the present Contract, to have taken cognizance of the terms, conditions, rights and obligations of the present Contract and to have understood them, by checking I accept.
